£91,000 fine for County Council

Suffolk County Council has been fines a total of £48,000 plus £43,772 costs for six failures to meet safety legislation, including:

  • A £14,000 fine for breaching S.3 of the Health and Safety at Work etc Act 1974, where a 9-year old primary school pupil suffered a fractured skull after he fell more than 1.5 metres from a climbing frame; the Council had ignored a requirement to provide an impact absorbing surface under the climbing frame and neglected to provide the school with enough information to ensure pupils could play on the climbing frame safely.
  • A £14,000 fine for two breaches of S.2 of the Health and Safety at Work etc Act 1974, where an IT technician fell, fracturing an arm while he was taking down a screen at the back of a stage after a school theatre production; he fell about four metres from a temporary aluminium platform that was being pushed along while he was on top of it. The Council had not provide adequate training for its employees and failed to monitor working at height in schools.
  • A £14,000 fine for breaching S.2 of the Health and Safety at Work etc Act 1974 and £6,000 for two breaches of the Control of Vibration of Work regulations at its highways department; these breaches related to the management of Suffolk Council’s highways department where employees had been working with vibrating machinery, four of whom had developed the hand arm vibration syndrome. The council had failed to adequately assess the risk from working with the equipment and exposing its workers to harm.

An HSE Inspector commented, “It is very disappointing to see a major employer like the County Council repeatedly fall short of its legal obligations to protect its workers and pupils. These cases show the need for all organisations to ensure that they understand the risks in their business and take sufficient steps to manage and monitor them. HSE will not hesitate to take action against any organisation, big or small, where it finds breaches of the law.”
